1. About these terms

By accessing or using this website (tchfinancial.site) you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use this website. These terms should be read alongside our Privacy Policy.

2. Who we are

TCH Financial Pty Ltd (ABN 48 702 576 609) is a financial planning and advisory practice based in Perth, Western Australia. References in these terms to "we", "us" and "our" mean TCH Financial Pty Ltd.

3. General information only — not personal advice

The content on this website, including articles, calculators and service descriptions, is general information only. It does not take into account your personal objectives, financial situation or needs, and it is not a recommendation to acquire, dispose of or hold any financial product. Before acting on any information on this website, you should consider its appropriateness having regard to your own circumstances.

Personal financial advice is provided only under a formal engagement with us and will be documented in a Statement of Advice where required by law. Nothing on this website creates an adviser–client relationship.

4. Engaging our services

Formal engagements for financial planning and advisory services are governed by a separate written engagement agreement between you and TCH Financial Pty Ltd. If there is any inconsistency between these terms and a signed engagement agreement, the engagement agreement prevails to the extent of the inconsistency.

5. Fees, quotes and payments

Fees for our services are set out in your engagement agreement or written quote. Quotes are valid for the period stated in the quote. Invoices are payable in accordance with the terms stated on the invoice. Where permitted, you may cancel an engagement in accordance with the notice provisions in your engagement agreement, and fees may apply for work performed up to the date of cancellation.

6. Australian Consumer Law guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law, which is set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.

If our services fail to meet a consumer guarantee that applies to them, you may be entitled to a remedy under the Australian Consumer Law. Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

7. Limitation of liability

To the fullest extent permitted by law, and subject to section 6 above, we are not liable for any loss or damage arising from your use of, or reliance on, this website or its content. We do not warrant that the website will be uninterrupted, error-free or free from harmful code, and we do not accept liability for the accuracy or completeness of information provided by third parties that appears on or is linked from this website.

All content on this website, including text, graphics, logos and design, is owned by or licensed to TCH Financial Pty Ltd and is protected by Australian copyright law.
